TERMS & CONDITIONS
This document containing the terms and conditions of use of the byfere.ro website (hereinafter referred to as "Terms and Conditions") establishes the conditions under which any person may visit or access the iamiza.com website or may use in any way the services offered through the Website. Within the meaning of the Terms and Conditions:
"Site" hereinafter means the website byfere.ro
“Site Administrator” hereinafter means FERE STYLING SRL (address: Prunesti Village, Albeni Commune, No. 63, Room 1, Gorj County; CUI: 33727908; J18/293/2017; email: marius.fierascu89@gmail.com; phone: 0799426580; IBAN accounts: RO32INGB0000999906775785 – RON)
"Service" means any service offered on the Site, and/or any module or component thereof;
"User" further means any person who visits or accesses the Site, who creates an account on the Site or who wishes to use in any way or actually uses the Service. Failure to accept these Terms and Conditions or any provision thereof, as they are formulated in this act, entails the obligation of the User to immediately cease accessing the Site; continued access or visit to the Site, any page thereof and/or use of the Service, as well as any component thereof, constitutes full and unconditional acceptance of the Terms and Conditions and any provision thereof.
By registering, the User fully and unconditionally accepts the provisions of these Terms and Conditions and agrees to use the Service in strict accordance with them. Users who create an account on the Site understand and accept that the use of their account, as well as any access or visit to the Site, any page thereof and/or use of the Service, as well as any component thereof, constitutes full and unconditional acceptance of the Terms and Conditions and any provision thereof; failure to accept the Terms and Conditions by the Users mentioned above entails their obligation to immediately cease accessing the Site.
Shipping, delivery and return policies
Shipping costs may vary depending on destination, weight, size. Shipping rates are set by courier companies and can be paid as the total amount of the package received. Delivery is made from Monday to Friday, between 10:00 and 18:00, within 1-10 business days from order confirmation. Orders placed during the day are considered the next day.
The return of the product(s) and the refund will be made within a maximum of 14 working days from its receipt by the customer/sender. The cost of the courier services performed based on the return/exchange will be fully borne by the customer. In the case of returning the product(s) in exchange for another product(s), the customer will send the product(s) he/she wishes to exchange and will send via email/Instagram the new order he/she wishes to place to the I AM IZA headquarters. The returned product(s) must be returned in the same conditions in which they were received (packaged and accompanied by all product labels), otherwise they may be refused upon receipt of the package.
Rights over the content of the Site
The content and graphic elements of the Site, including but not limited to, all text content and any other material, transmitted in any form by and to Users (through direct viewing on the Site, through newsletters or through any other materials directly or indirectly related to the Site) belong to the Site Administrator and represent the content of the Site. By way of derogation from the previous provision, the Site Administrator does not own those materials for which another rights holder, or another owner or another source, the information provided to Users, or the opinions and/or comments of any kind expressed by the Site Users regarding materials of any kind posted on the Site or regarding the Site Content in general. The User undertakes to respect all copyrights and any other intellectual property rights that the Site Administrator and its partners hold over/in relation to the Site, its content, the Service, any module or component thereof or in relation to their use.
The Site Content, regardless of the area in which it is located on the Site and regardless of the type, may be used exclusively for personal purposes. Any use of content by third parties for any purposes other than personal, may only be made with the express and prior written consent of the Site Administrator.
It is prohibited to copy, take over, reproduce, publish, transmit, sell, distribute partially, completely or modified the content of this Site or any part thereof for purposes other than personal.
The Site Administrator reserves the right to take legal action against any person and/or entity that violates the above provisions in any way.
Requests to use the Site's content for any purpose other than personal may be made through any of the methods indicated on the Site's Contact page.
Any person who sends information or materials to the Site in any way assumes the obligation not to prejudice in any way the copyrights or any other intellectual property rights that a third party could invoke in connection with the materials and information transmitted in any way to the Site, and the persons who send information or materials in any way understand and accept that the violation in any way of this obligation cannot in any way engage the Site Administrator's liability, but only the liability of the respective persons.
Users understand and accept that any information present on the Site is not and cannot be considered an offer of products and/or services coming from the Site Administrator.
It is prohibited to use this Site, the Site Content, the Service or any service, facility or offered by the Site for commercial purposes, for example to recruit employees by employers, for service offers by employers but not limited to these, without the written consent of the Site Administrator.
Users understand and accept that all information, data, materials posted on the Site are for informational and indicative purposes only, and that the Site Administrator cannot be held liable under any circumstances or in any way for the veracity and validity of the Site Content, including but not limited to the veracity and correctness of the information and data provided by Users on the Site, or for any legal effect arising from their use.
It is strictly forbidden to post on the Site any content, including but not limited to materials, comments, images, video sequences, that contain obscene or vulgar language, illegal, threatening, abusive, indecent texts, racist, chauvinistic messages or that could discriminate against any person in any way, or that would violate any other human rights and freedoms according to the legislation in force.
Users undertake to provide valid, valid, accurate, truthful and correct data and information when registering on the Site, when accessing and using the Service, as well as in any activity of accessing and using the Site, in order to offer or benefit from services through the Site.
Users understand and accept that in the event of any violation in any way and to any extent of any of the provisions of the Terms and Conditions, the Site Administrator may, at its discretion, opt for total or partial suspension of access.

The Site Administrator has the right to block and delete user accounts, without reason, whenever he wishes, and without prior notice to the respective user.

Information note on personal data protection
The Site Administrator is a personal data controller registered in the register of personal data processing under no. 36434.
In accordance with the requirements of Law no. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented, and of Law no. 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector, the Site Administrator will manage in a secure manner and only for the specified purposes, the personal data provided by the Users. We inform you that the personal data that the Users provide to the Site Administrator are processed for the purpose of providing the Service in optimal conditions. Users understand and accept that the personal data they provide are processed for the purpose of providing the Site Administrator with the Internet services and services for the purpose of advertising, marketing and publicity in optimal conditions.
Each User, at his own option, provides some personal data in order to create a valid account and to benefit from the Service offered by the Site Administrator. When creating the account, each User has the possibility to opt in to receive information about the products, services, events, etc. offered by the Site by checking the corresponding box on the account creation page.
The recorded information is intended for use by the operator and is communicated only to the following recipients: data subjects, contractual partners of the operator.
According to Law no. 677/2001, each User has the right to access, to intervene in the data, the right not to be subject to an individual decision and the right to address the courts. At the same time, each User has the right to oppose the processing of personal data concerning them and to request the deletion of the data. Users understand and accept that the deletion of their personal data will be followed by the deletion of their account from the system and the impossibility of accessing the Service offered by the Site Administrator.
To exercise these rights, each User may submit a request to the address marius.fierascu89@gmail.com. Also, each User is recognized as having the right to address the courts.
Link to other sites
Users understand and accept that the Site may contain links or references to other websites, including, but not limited to, the websites of product and/or service providers to which the advertising banners posted on the Site or advertising microsites, personal websites (blogs) are sent.
The Site Administrator may provide information useful in connection with the Site Content, but which is not under its control or guidance.
The Site Administrator is absolved of any liability regarding the content or opinions expressed on all the aforementioned websites, as well as their correctness and accuracy, and Users understand and accept that these websites are not monitored, controlled or verified in any way by the Site Administrator. The inclusion of a link or reference to other websites does not imply their approval in any way by the Site Administrator. When Users access these websites, they do so at their own risk, knowing that the use of the services offered by these websites is subject to the conditions established by the administrators of these websites.
Limitation of liability
The Site Administrator assumes no liability and does not guarantee implicitly or expressly for the content of any kind of the Site, including but not limited to all content and services offered by Users. The Site Administrator will make all reasonable efforts to ensure the accuracy and reliability of the Site and will try to correct errors and omissions as quickly as possible.
The Site Administrator does not provide any guarantees or liability for the offers, services, information made available through the Site by Users, or for the Site Content, and under no circumstances can it be held liable for any loss or damage that may result from the use of any part, sequence, mode of the Content on the Site, the Service or from the impossibility of using it, regardless of its cause, or from the misinterpretation of any provisions of the Site Content.
The Site Administrator does not guarantee the offers, information, data of the Users made available through the Site. The entire responsibility for the offers, services and content, but not limited to these, sent by the Users to be posted on the Site belongs to the Users who sent or posted them on the Site, and the Users understand and accept that they use them at their own risk. In no case can the Site Administrator be held liable for any loss or damage that may result from the failure to fulfill any obligations assumed by any User, from the impossibility of using the Service, or from the erroneous interpretation of the Site Content.
Users understand and accept that the Site Administrator is only an intermediary between Users, who provides a communication platform, so that all services and facilities related to the use of the Site, as well as all data, information contained therein are provided "as is", "as available", and Users use them at their own risk. Users understand and accept that the Service provided on the Site is provided "as is", "as available" and they use it at their own risk. Users understand and accept that the provision of the Service may be affected by certain
objective conditions, as well as that any services offered through the Site are offered according to the principle "as is", "as available", and Users use these services at their own risk. Consequently, the Site Administrator cannot be held liable for any information and data from the Site Content, including but not limited to those regarding offers, services, data and information related to the use of the Service, or any other activity related to the use and access of the Service and / or the Site, as well as any other legal effect deriving from them.
Users understand and accept that the Site Administrator does not participate in any way and to any extent in the interactions between Users and does not provide any guarantee regarding them. Users understand and accept that the Site Administrator has no control over the legality, quality, correctness, punctuality, credibility and accuracy of the services, data and information or any content or services offered by Users through the Site, or offline (which is not carried out via the Internet). Users understand and accept that due to the specific characteristics of the Internet and the Service, the Site Administrator cannot confirm, guarantee the identity of the Users and the veracity, correctness, validity of any information or content offered by them on the Site. Consequently, the Site Administrator cannot be held liable in any way and to any extent regarding this information or any other legal / commercial effects deriving from their use.
Users understand and accept that the Site Administrator is absolved of any liability in the event of any stoppage, interruption, difficulty, malfunction or error in the operation of the Site, in the event of a technical error of any kind or any errors in the provision of the Service, as well as in any situation in which it is not proven that any errors or problems of a technical nature mentioned above are directly and exclusively due to the serious fault of the Site Administrator.
Expressly, Users understand and accept that the Site Administrator is absolved of any liability for any direct, indirect damages, including but not limited to loss of profit, commercial damage or other intangible losses, resulting from the use of the Service or any other aspect related to the Service as well as from the use of the Site Content in any way or any legal effects deriving therefrom.
Users understand and accept that the Site Administrator is absolved of any liability for advertising messages, for the content posted on the Site by Users, as well as for the goods or services provided by the authors of these advertising messages or content posted on the Site through the Service.
In cases of force majeure, the Site Administrator and/or its operators, directors, employees, branches, subsidiaries and representatives are fully exempted from liability. Cases of force majeure include, but are not limited to, malfunctions of the Site Administrator's technical equipment, lack of internet connection, lack of telephone connections, computer viruses, computer attacks of any kind and interference with malicious computer programs, unauthorized access to the Site's systems, operating errors, strikes, etc.
Users agree to protect, insure and fully indemnify the Site Administrator and/or its operators, directors, employees, branches, subsidiaries and representatives from and against any requests, claims, actions, impositions, losses, damages, costs (including, without limitation, attorneys', experts' and consultants' or executors' fees, judicial, notary or enforcement fees), expenses, judgments, decisions, fines, regularizations or other obligations resulting from or related to any other action of the User in connection with the use of the Service or any other aspect in connection with the Service.
Applicable law. Disputes
The rights and obligations of the Users and the Site Administrator, provided for by the Terms and Conditions, as well as all legal effects produced by the Terms and Conditions, will be interpreted and governed in accordance with the Romanian law in force. Any dispute arising from or in connection with the Terms and Conditions will be resolved amicably. In case of impossibility of reaching an agreement, the dispute will be resolved by the competent Romanian court located within the territorial jurisdiction of the municipality of Bucharest.
Compliance with the law
Site users are required to declare, according to the law, the income generated from the provision of services and to comply with all applicable laws.
Modification of Terms and Conditions
The Site Administrator has the right to modify at any time and in any way any of the provisions of the Terms and Conditions or the Terms and Conditions in their entirety, without any prior notice and without being obliged to fulfill any other formality towards the Users. Any modification will be considered as fully and unconditionally accepted by any of the Users by simply using or accessing any facility offered by the Site or the Service, or by accessing the Site, occurring at any time after the modification is made, and failure to accept any modification entails the obligation of the respective User to immediately cease accessing the Site and/or using the Service in any way.
